Protected area violates indigenous peoples' rights says African Commission

A 'landmark' decision of the African Commission on Human and Peoples' Rights has affirmed the right of the Endorois pastoralists of Kenya to own their customary lands and to 'free, prior and informed consent', rights which were violated when they were removed from a protected area. The decision invokes the UN Declaration on the Rights of Indigenous Peoples and draws on the findings of the Inter-American Court of Human Rights. The case has major implications vindicating the right of all indigenous peoples to restitution for lands taken without their consent to create national parks and reserves.

    CERD letter to Government of Brazil

    UN Commitee on the Elimination of Racial Discrimination (CERD) expresses grave concerns that the security and respect for the land rights of the Macuxi, Wapichana, Taurepang, Ingaricó and Patamona indigenous peoples of Raposa Serra do Sol (RSS) in the State of Roraima, Brazil “has not improved or has even deteriorated.” Strong recommendations include completion of “the final and total removal of non-indigenous occupants of the RSS indigenous lands”. CERD calls upon the Government to report to them by 30 November 2007.

    The main response in Europe to the trade in illegal timbers has been to develop a process of 'Forest Law Enforcement, Governance and Trade' (FLEGT). The scheme requires verification of the legality of timbers. How will such a process ensure that the rights and needs of local communities, indigenous peoples, women and workers are taken into account?
