What are the prospects for securing the land rights of indigenous peoples, local communities, and women in the foreseeable future?

Significantly, the report of the United Nations Secretary-General’s High Level Panel of Eminent Persons on the Post-2015 Development Agenda, under Goal 1 to “End Poverty”, sets a target to “Increase by x% the share of women and men, communities, and businesses with secure rights to land, property, and other assets”.

UN OHCHR: UN rights chief Navi Pillay urges States to do more to respect treaties with indigenous peoples

"GENEVA (07 August 2013) –States need to do more to honour and strengthen their treaties with indigenous peoples, no matter how long ago they were signed, UN human rights chief Navi Pillay has said in a statement to mark International Day of the World’s Indigenous Peoples on 9 August.

“Even when signed or otherwise agreed more than a century ago, many treaties remain the cornerstone for the protection of the identity, land and customs of indigenous peoples, determining the relationship they have with the State. They are thus of major significance to human rights today,” she said.

Mutual recognition, mutual respect and mutual benefit are among the desirable attributes of all human relationships. Indigenous peoples and other forest peoples also expect these qualities in their relationships with others – be they governments, private corporations, NGOs or other indigenous peoples’ organisations and communities. This issue of Forest Peoples Programme’s E-Newsletter reports on the state of various relationships between forest peoples and different institutions – as these are forged, tested or broken –in the course of assertions for upholding basic human rights, social justice and solidarity.

Los pueblos indígenas y otros pueblos de los bosques también esperan estas cualidades en sus relaciones con otros, ya sean gobiernos, empresas privadas, ONG u otras organizaciones y comunidades de pueblos indígenas.  Este número del boletín electrónico de noticias del Forest Peoples Programme informa del estado de varias relaciones entre pueblos de los bosques y diferentes instituciones, mientras estas son forjadas, puestas a prueba o rotas, en el curso de las afirmaciones de la defensa de los derechos humanos básicos, la justicia social y la solidaridad.

La reconnaissance mutuelle, le respect mutuel et les avantages réciproques figurent parmi les attributs souhaitables de toute relation humaine. Les peuples autochtones et les autres peuples des forêts s’attendent eux aussi à trouver ces qualités dans leurs relations avec des tiers, qu’il s’agisse de gouvernements, d’entreprises privées, d’ONG ou d’autres organisations et communautés de peuples autochtones. Cette édition du bulletin d’information du Forest Peoples Programme rend compte du statut de diverses relations entre les peuples des forêts et différentes institutions, au fur et à mesure de leur établissement, mise à l’épreuve ou rupture, suite à des revendications en faveur du respect des droits humains fondamentaux, de la justice sociale et de la solidarité.

There is now greater awareness that what is urgently needed is strengthened environmental stewardship and land governance, reforms of land tenure, and improved enforcement of revised and just laws.

L’indignation générale concernant les déprédations d’un commerce mal réglementé a conduit à la reconnaissance croissante des responsabilités des entreprises de respecter les droits humains, ainsi que de la nécessité de réglementations renforcées afin d’améliorer la façon dont les produits sont fabriqués et de s’assurer que l’environnement et les droits des personnes soient respectés et protégés.

Kemarahan publik mengenai berbagai penghancuran dari bisnis yang buruk telah mengarah pada suatu peningkatan pengakuan atas berbagai tanggung jawab kalangan dunia bisnis utnuk melindungi HAM, dan kebutuhan akan kebijakan yang lebih kuat untuk memperbaiki cara produk-produk dibuat dan memastikan bahwa lingkungan dan hak masyarakat dihormati dan dilindungi. Saat ini muncul kesadaran yang lebih besar  akan perbaikan pengelolaan lingkungan dan governansi lahan, reformasi kepemilikan tanah, dan meningkatnya penegakan hukum yang diperbaiki dan adil. Perubahan semacam ini perlahan mulai bergulir, jadi kosumen dan pembeli ditekan untuk perubahan yang lebih cepat. Hal ini telah menyebabkan meningkatnya penyusunan-standar oleh sektor swasta untuk pengaturan produksi dan pengolahan komoditas untuk mengormati hak, menjamin sumber mata pencarian yang menguntungkan dan berkelanjutan serta mengalihkan tekanan dari kawasan-kawasan penting bagi sumber pengidupan lokal dan nilai konservasi tinggi. Banyak standar yang telah dikembangkan mengakui pentingnya perlindungan hak-hak adat atas tanah dan sumber daya alam lainnya serta hak atas keputusan bebas, didahulukan dan diinformasikan (KBDD/FPIC) antara lain untuk kehutanan, hutan tanaman, minyak sawit, kedelai, tebu, tambak, biofuel/bahan bakar nabati dan penyerapan karbon.

A indignação pública com relação as depredações realizadas por empresas malreguladas levou a um maior reconhecimento das responsabilidades que as empresas têm em respeitar os direitos humanos, assim como a necessidade de regulações mais estritas para melhorar as formas de produção e garantir a proteção e o respeito pelos ambientes e os direitos dos povos indígenas. Atualmente, existe uma maior conscientização de que é urgentemente necessário fortalecer a administração ambiental e a governança relacionada às terras, reformas relativas à posse da terra e uma melhor aplicação de leis justas e revisadas. Estas reformas estão demorando em serem implementadas. Consequentemente, os consumidores e compradores estão pressionando para que haja mudança mais rápidas. Isso deu lugar ao surgimento de normalizações por parte do setor privado para a regulação da produção e processamento de commodities, com a finalidade de respeitar os direitos, assegurar meios de vida favoráveis e sustentáveis, e desviar a pressão das áreas vitais para a subsistência local e com elevado valor de conservação. As normas, que reconhecem a importância da proteção dos direitos consuetudinários relacionados à terra e a outros recursos naturais, e o direito ao consentimento prévio, livre e informado, agora foram desenvolvidas para inter alia a silvicultura, propriedades madeireiras, óleo de palma, soja, açúcar, aquicultura, biocombustíveis e sequestro de carbono.
