At a recent event of the All-Party Parliamentary Group (APPG) for Global Deforestation, Shipibo leader Apu Miguel Guimaraes shared the experience of ongoing human rights violations suffered by the community of Santa Clara de Uchunya, including the dispossession of their land and consequent conflicts.

Between 24 and 25 October 2022, members of the Shipibo-Konibo Indigenous community of Santa Clara de Uchunya met in Yarinacocha to reflect on their efforts past and present to defend their ancestral territory against agribusiness-led land trafficking and deforestation and oil palm expansion in the Ucayali region of the Peruvian Amazon. They issued the following agreement and made additional statements during a press conference with regional media.

Entre el 24 y el 25 de octubre de 2022, miembros de la comunidad indígena Shipibo-Konibo de Santa Clara de Uchunya se reunieron en Yarinacocha. En la reunión se reflexionó sobre sus esfuerzos pasados y presentes para defender su territorio ancestral contra el tráfico de tierras, la deforestación y la expansión de la palma aceitera impulsados por la agroindustria en la región de Ucayali de la Amazonía peruana. Se emitió el siguiente acuerdo e hicieron declaraciones adicionales durante una conferencia de prensa con los medios de comunicación regionales.

Through a public statement, community members from Santa Clara de Uchunya, a community belonging to the Shipibo-Konibo people, categorically reject the continued presence of the Ocho Sur company on their lands. Ocho Sur continues to violate their collective rights and attempts to sow internal divisions that would favour their commercial interests. 

A través de un pronunciamiento público, las comuneras y los comuneros de Santa Clara de Uchunya, del pueblo shipibo-konibo, rechazan tajantemente la continua presencia de la empresa Ocho Sur que sigue vulnerando sus derechos colectivos y pretende generar divisiones internas para favorecer sus intereses comerciales.

(Spanish only) The Shipibo-Konibo people in the community of Santa Clara de Uchunya, along with their representative organisation FECONAU, met with the Inter-American Court on Human Rights (IACHR) and the Peruvian state. The community highlighted the necessity for the concrete implementation of precautionary measures with an intercultural approach, due to the threats and harassment they are experiencing as a result of defending their land.

​​​​​​​La comunidad Santa Clara de Uchunya del pueblo shipibo-konibo y su organización representativa la Federación de Comunidades Nativas del Ucayali y Afluentes (FECONAU) se reunieron con la Comisión Interamericana de Derechos Humanos (CIDH) y el Estado peruano para remarcar sobre la necesidad de una implementación concreta y con aproximación intercultural de las medidas cautelares recibidas a su favor debido las amenazas y hostigamiento resultantes de sus acciones de defensa territorial.

The case of Santa Clara de Uchunya and their fight to obtain justice and regain their territory

The RSPO has upheld that Peruvian palm oil miller OLPESA must not buy or process palm from deforested Indigenous lands, which were converted to a plantation which the RSPO condemned in 2016. However, its decision fails to dispel the spectre of human rights violations and large-scale deforestation from agroindustrial supply chains given the limited scope of the RSPO’s own standards.

La RSPO ha afirmado que la planta extractora de aceite OLPESA no debe comprar ni procesar palma de tierras indígenas deforestadas en el Perú, que se convirtieron en una plantación condenada por la RSPO en 2016. No obstante, su decisión no logra disipar el espectro de las violaciones de derechos humanos y deforestación a gran escala en las cadenas de suministro de productos agroindustriales debido al alcance limitado de los estándares de la RSPO.
