Guide pratique : Garantir les droits fonciers coutumiers en RDC

This practical guide highlights the extent of recognition of customary land rights of forest-dependent communities in the DRC. At the same time, it analyses the shortcomings and shortcomings of the existing legal and regulatory framework on access to land, customary tenure, the use of natural resources in traditional lands, and it outlines the characteristics of land tenure in DRC.
The guide explores existing opportunities for securing customary tenure of communities through community forestry as an option, and at the same time proposes viable options for positively influencing the ongoing land reform process as well as the process of allocating spaces or land use planning, including the recognition of collective ownership, non-discrimination against the most marginalised, including the indigenous peoples, the inclusion and effective participation of communities in the decisions that affect them, and the right to Free Prior and Informed Consent (FPIC).
