This report offers alternative information in response to the combined 12th and 13th
Kenyan Government’s report submitted to the African Commission on Human and
Peoples’ Rights (‘ACHPR’) pursuant to Article 62 of the African Charter (the ‘Kenyan
periodic report’). It focuses largely on the extent to which the Kenyan Government has
adhered to its obligations under the African Charter with regard to indigenous peoples,
groups and communities.
This report is informed by the current political, legal and social environment in Kenya.
Specifically, the information in the report is drawn from diverse sources including the
Constitution of Kenya 2010 and other laws, information from various institutions as well as
from sources within the indigenous communities.
This report has been developed jointly by various marginalized and indigenous groups under
the convening of the Ogiek People’s Development Programme (OPDP), Endorois Welfare
Council, Chepkitale Indigenous Peoples Development Project, Sengwer Indigenous Peoples
Programme, and Sengwer of Embobut CBO with support from Minority Rights Group
International (MRG) and Forest Peoples Programme (FPP).
